Terms of service

The plain-language rules for working with eCommWiz and for using our software, including the crosslisting tool for eBay, Poshmark, Mercari, Depop, and Facebook Marketplace.

These terms are an agreement between you and eCommWiz, LLC of Jacksonville, Florida. By using ecommwiz.com, hiring us, or using our software, you agree to them.

Services

Marketing, design, development, and consulting work is defined by the proposal or invoice you approve — that document controls scope, price, and timeline. Starting prices published on this site are starting prices; your quote is your price. Work begins when the agreed deposit or invoice is paid. You own the deliverables we build for you once they are paid for; we may show the work in our portfolio unless you ask us not to.

The crosslisting software

When our crosslisting tool is available, these terms apply to it:

Your license

We grant you a personal, non-transferable license to use the software under the plan you purchase. Plans, features, and pricing will be published when the software launches, and subscriptions can be canceled any time, effective at the end of the paid period.

Your responsibilities

You are responsible for your listings — their accuracy, their legality, and their compliance with each marketplace’s rules. The tool publishes what you tell it to publish. You agree to use the software only with accounts you own, to keep your login private, and not to use the tool to spam, misrepresent items, or violate eBay, Poshmark, Mercari, Depop, or Facebook Marketplace policies. Breaking a marketplace’s rules can get your account suspended by that marketplace, and that is between you and them.

The marketplaces are not ours

eBay, Poshmark, Mercari, Depop, and Facebook Marketplace are independent platforms. They change their systems, rules, and access without warning, and any of them can limit or end the connections our software depends on. We work to keep every connection running, but we cannot guarantee that a marketplace will remain available inside the tool, and we are not responsible for their decisions, outages, fees, or actions against your account.

Acceptable use of this website

Do not attempt to break, probe, scrape at abusive rates, or misuse the site or our systems.

Disclaimers

Services and software are provided “as is.” We do our best work and stand behind it, but we do not guarantee specific business results — rankings, sales, or approval decisions by third parties are outside anyone’s honest control.

Limitation of liability

To the fullest extent the law allows, eCommWiz’s total liability for any claim is limited to the amount you paid us for the service or software subscription giving rise to the claim in the twelve months before it arose, and we are not liable for indirect or consequential damages, including lost profits or marketplace account actions.

Termination

You can stop using the site or software at any time. We can suspend or end access for breaking these terms. Sections that by their nature should survive — payment obligations, disclaimers, liability limits — survive.

Governing law

These terms are governed by the laws of the State of Florida, and disputes will be handled in the state or federal courts located in Duval County, Florida.

Changes

We may update these terms; the date at the top will change, and continued use after a change means you accept it.
